Give Back Competition – T&C’s
- Information on how to enter and gifts available pursuant to this competition form part of these Conditions of Entry. Participation in this competition is deemed acceptance of these Conditions of Entry. Entry is via internet only.
- Entries into the competition open 12:01pm (AEDT) on 12 November 2023 and close at 11:59pm (AEDT) on 10 December 2023 (“Competition Period”).
Eligibility
- Entry is only open to Australian residents aged 18 years (“Entrant”).
- Employees (and their immediate families) of the Promoter, Competition Partners and agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- To enter the competition, Entrants must complete the following steps during the Competition Period:
- Send an email to ‘The Inspired Unemployed’ via giveback@bornbredtalent.com including the following information:
- the Entrant’s full name;
- contact details including telephone number; and
- complete a written submission, in 50 words or less, “explaining why you need a helping hand”.
- Send an email to ‘The Inspired Unemployed’ via giveback@bornbredtalent.com including the following information:
- Entrants will receive a confirmation email verifying that their entry has been received by the Promoter.
- Only one (1) entry per person or organisation is permitted. Any subsequent entry received from an individual Entrant or Entrant on entering on behalf of an organisation after the first valid entry has been received will be deemed invalid.
- Any cost associated with accessing or entering the competition is the Entrant’s responsibility and is dependent on the Internet service provider used.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, at its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the competition. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
- Incomplete or ineligible entries will be deemed invalid.
Intellectual Property
- Without limiting any of the provisions of these Conditions of Entry, the Promoter requires that each Entry fully complies with these Conditions of Entry and must not include or make reference to the Intellectual Property Rights of any person, unless the Entrant has obtained the written consent of the owner of the applicable Intellectual Property Rights. An entry submitted without obtaining such consent may result in the entry becoming invalid for the purposes of the competition and/or the Entrant being subject to legal liability.
- Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive, obscene, crude or inappropriate in any way or that the Promoter considers may infringe any intellectual property rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the competition. This includes but is not limited to any entry which the Promoter considers to be disparaging of any of its or any supplier’s products and/or services or is otherwise not in keeping with the spirit of the competition. The decision by the Promoter to accept or reject an entry is in the Promoter’s sole discretion and no correspondence will be entered into.
- As a condition of entering this competition, each Entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
- By entering the competition, each Entrant warrants to the Promoter that:
(a) the content in their entry is original;
(b) they have the authority and all permissions necessary to submit their entry;
(c) they own the content of their entry and consent to its use in any media in any manner and in any form, worldwide in perpetuity; and
(d)their entry does not violate the privacy rights, copyright, contract rights, or other rights (including but not limited to Intellectual Property Rights) of any other person, corporation or entity.Beneficiary Determination
- All eligible entries will be judged by the Promoter and a panel of appropriately qualified judges by 10th February 2024 to determine the beneficiaries of the competition. All eligible entries will be judged individually on merit and the Entrant’s response to the entry question. This is a game of skill and chance plays no part in determining the winners.
- Entrants who have been determined as beneficiaries of the competition will be notified in writing via the email address from which their entry into the competition was received by 10th February 2024. All reasonable steps to notify Entrants of the results of the judging will be taken by the Promoter.
- The Entrant must confirm their eligibility to receive a gift and their ability to accept the gift within seven (7) business days of being successfully contacted by the promoter, otherwise their entry will be deemed invalid. The Promoter’s decision is final and no correspondence will be entered into.
- The judges may select additional reserve entries, and record them in order, in case of an invalid entry, ineligible entrant or forfeiture.
- Where an Entrant has entered the competition on behalf of a not-for-profit or their employer, the Promoter may contact the organisation nominated as part of the entry as the beneficiary of the competition. In the event of a dispute between an Entrant and the nominated beneficiary as to who is eligible to receive any gift, the gift will be awarded to the nominated organisation.
- The Promoter reserves the right to request an Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the winner’s identity and eligibility to enter, before any gift is issued.
Gift Details
- The entries judged as beneficiaries of the competition will receive a gift as determined by the Promoter in its sole discretion.
- If for any reason a beneficiary does not accept their gift within the time stipulated by the Promoter, then the gift will be forfeited and will not be redeemable for cash.
- In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend, substitute or modify a gift.
General
- It is a condition of accepting a gift that beneficiaries may be required to sign an acceptance release in a form determined by the Promoter in its absolute discretion.
- Beneficiaries consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome) and promoting any products of the Promoter. The winner agrees that, in the event they are a winner, they will participate in all reasonable promotional activities in relation to the competition as requested by the Promoter and its agents.
- The Promoter and its associated agencies and companies exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the competition. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this competition and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries; and/or (iv) acceptance and/or use of any gift.
- To the extent permitted by law, each Entrant indemnifies and must defend and hold harmless, the Promoter and its employees, servants, agents and contractors, from and against all Losses arising from: (i) a breach by the entrant of any of these Conditions of Entry; (ii) any third party claim arising directly or indirectly from a breach by the Entrant of any of these Conditions of Entry; (iii) a negligent, wilful or otherwise wrongful act or omission of the Entrant; (iv) fraudulent or dishonest acts or omissions by the Entrant; (v) any breach by the Entrant of any applicable Laws; (vi) any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the Entrant entering the Competition; and (vii) any claim or allegation that the Entrant’s entry infringes a third party’s Intellectual Property Rights of constitutes an unlawful disclosure or misuse or misappropriation of another party’s information.
Privacy
- Selected partners, trusted third parties, promotional agents and suppliers of the Promoter (“Competition Partners”) may require Entrants provide Personal Information in order for them to process a beneficiary’s gift. Entrants must satisfy themselves with the privacy policies of any Competition Partners, as the Promoter will not accept any responsibility for the handling of Personal Information by Competition Partners.
- The Promoter and its Competition Partners collect Personal Information in order to award a beneficiary any gift pursuant to the competition. Where the Promoter collects an Entrant’s Personal Information, the Promoter will provide the Entrant with a collection statement that details the Personal Information being collected, the purpose of its collection, where the Personal Information will be stored and how it will be shared with third parties. The collection statement will comply with the Promoter’s disclosure obligations under the Privacy Act 1988 (Cth). Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter.
- In these Conditions of Entry: “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth); “Intellectual Property Rights” means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents0, trade marks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable and whether existing in Australia or otherwise; “Laws” means all laws including rules of common law, principles of equity, statutes, regulations, proclamations, ordinances, by-laws, rules, regulatory principles and requirements; “Losses” means loss, damage, liability, charge, expense, or cost (including reasonable legal and other professional costs on a full indemnity basis) of any nature or kind; and “Personal Information” means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
